What the Kansas Legislature has refused to do may be left up to the courts.
Since the start of June, the U.S. Justice Department has challenged state laws in Texas, Kentucky and Minnesota that provide immigrants living in the United States illegally reduced in-state tuition at higher education institutions.
Since 2004, Kansas has had a law granting in-state tuition to the children of immigrants here illegally who graduated from a Kansas high school and pledged that they intended to become citizens.
There have been efforts - in the courtroom and at the statehouse - to repeal the Kansas law . . .
