Outgoing lawmaker pleads no contest in DUI case

Outgoing Republican state Rep. Carl Maughan of Colwich has pleaded no contest to driving under the influence stemming from a traffic stop earlier this year.

Maughan pleaded no contest Monday to first offense DUI that arose from a traffic stop in Topeka last March, court records show.

A Shawnee County judge dismissed three other charges: possession of firearm while under the influence of alcohol or drugs, failure to signal a lane change and failure to maintain a single lane.

Magistrate Judge Chris Turner fined Maughan $750 and sentenced him to three months in jail.

But Maughan was given six months of unsupervised probation and as long as he complies with the drug and alcohol recommendations, he won’t serve time in jail.

He also will have to pay another $158 in court costs and a surcharge.

Maughan was stopped March 4 at about 12:30 a.m. when officers observed traffic infractions near Southwest 29th Street and Topeka Boulevard.

Officers initiated a traffic stop and identified the driver as Maughan.

As a result of the investigation, Maughan was later arrested and booked into the Shawnee County Department of Corrections.

Maughan didn’t actively seek reelection this year following a separate car crash in Wichita.

Republican state Rep. Steve Huebert of Valley Center won the primary election to represent House District 90.

Huebert faces Democrat Tracy Edingfield in the general election.

In an interview after his arrest in March, Maughan acknowledged making some “poor judgments” and readily said he expected to face a drunk-driving charge.

“I messed up and I shouldn’t have,” he said in an interview after his arrest in March.

“From here on out, I kind of need to just kind of own the responsibility and maybe try to learn something.”

Maughan said he didn’t think he would be fighting the situation from a “legal standpoint.”

“What happened, happened,” he said. “I need to be a little more introspective about it.”
