Lyon County says legal precedent supports removing candidate from ballot

Lyon County says its election commissioner legally removed a sheriff's candidate from the ballot despite an expunged criminal conviction from the past.

In a filing with the Kansas Supreme Court, the county says that court precedent supported Tammy Vopat's decision to remove Daniel Klingensmith's name from the ballot in the Aug. 6 primary against incumbent Jeff Cope.

Vopat based her decision on a report from the Kansas Bureau of Investigation that found  Klingensmith had an expunged criminal conviction that would constitute a misdemeanor crime of domestic violence or a felony under state law.
