A Shawnee County judge on Wednesday declined to issue a subpoena to a state contractor that coordinated the evaluation of bids for the state's new Medicaid contracts.
District Judge Thomas Luedke instead asked the state to find out if the consultant - Mercer Health & Benefits of Topeka - had some of the records sought by Aetna Better Health.
The state has until next Monday to let the court know whether Mercer has the documents Aetna is seeking.
