Appeals court rejects appeal of abortion injunction as moot

A state appeals court on Thursday rejected an appeal of an injunction handed down by a lower court that blocked enforcement of state abortion restrictions.

In a ruling for the court issued by Judge G. Gordon Atcheson, the appeal was determined to be moot because the state had already agreed not to enforce the law, including a 24-hour waiting period for women seeking an abortion.

Atcheson said the appeal became moot when the state agreed not to enforce the challenged statutes until the district court issued a final judgment.
