Kansas Attorney General Derek Schmidt said Monday it was debatable whether Gov. Laura Kelly had the authority to issue a second emergency declaration to battle the coronavirus pandemic.
"There is a legitimate debate about whether the governor had the authority to issue this successive state-of-disaster proclamation, essentially arising from the same disaster," Schmidt told the House Judiciary Committee on Monday afternoon.
"I can articulate an argument in favor of that authority, as I know the governor's team can," he said. "I can articulate an argument against that authority."
